BFA-IT END USER LICENSE AGREEMENT ("EULA") 
ATTENTION: READ THIS LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING. YOU MAY NEED TO SCROLL DOWN TO THE END OF THIS EULA BEFORE YOU CAN AGREE TO THE EULA AND CONTINUE WITH THE SOFTWARE INSTALLATION. 
THIS SOFTWARE END USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU 
(EITHER AN INDIVIDUAL OR, IF PURCHASED OR OTHERWISE ACQUIRED BY OR FOR AN ENTITY, AN 
ENTITY) AND BFA-IT. READ IT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THIS SOFTWARE. IT PROVIDES A LICENSE TO USE THIS SOFTWARE AND CONTAINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY CHECKING THE AGREEMENT CHECKBOX BELOW OR BY DOWNLOADING, INSTALLING, COPYING OR OTHERWISE USING BFA-IT'S SOFTWARE YOU AGREE TO BE BOUND BY ALL OF THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT DOWNLOAD, INSTALL, COPY OR OTHERWISE USE THE SOFTWARE.THIS AGREEMENT SUPERSEDES PREVIOUS VERSIONS. 

I. SOFTWARE 
As used in this Agreement, the term "Software" refers to the BFA-IT software which you have selected to download. The term "Software" also includes any third party software provide to you as part of or with the software (as an independent work).

II. GRANT OF LICENSE 
1) Trial License. You may download and use the trial version of the Software (the "Trial Version”) for free only for a limited trial period (the "Trial Period"). During the Trial Period, BFA-IT grants you a limited, non-exclusive, non-transferable, non-renewable license to install and use the Software for evaluation purposes only and not for any commercial use.  At BFA-IT’s discretion, BFA-IT may provide limited support through email. The evaluation copy of the Software contains limited functionality. BFA-IT will have no liability to you for this limited functionality. 
2) License after Trial Period. This Software is licensed, not sold. After the Trial Period, You have the option of paying a license fee in order to use the Software. Upon your payment of the license fee, BFA-IT provides you with a permanent registration number ("Serial Number") and grants you a limited, non-exclusive, non-transferable license subject to the term of this Agreement. 

III. LICENSE RESTRICTIONS 
You acknowledge that the foregoing license extends only to your use of the features and functionality of 
the Software as described in the documentation accompanying the version of the Software 
downloaded by you (the "Documentation"), and you agree not to reconfigure or modify the Software in 
order to enable features or functionality different than those described in such Documentation or 
available in other BFA-IT products. You may not: (i) reverse engineer, decompile, or disassemble the Software; (ii) modify, or create derivative works based upon, the Software in whole or in part; (iii) distribute copies of the Software; (iv) remove any proprietary notices or labels on the Software; (v) resell, lease, rent, transfer, sublicense, or otherwise transfer rights to the Software; (vi) disclose the results of software performance benchmarks obtained using the Trial Version to any third party without BFA-IT's prior written consent, or (vii) use the Trial Version of the Software for a purpose other than the sole purpose of determining whether to purchase a license. Any use in violation of this Section III shall immediately terminate your license to the Software.

IV. LICENSE TO DISTRIBUTE SOFTWARE. Subject to the terms and conditions of this Agreement , BFA-IT grants you a non-exclusive, non-transferable, limited license without fees to reproduce and distribute the Software "JarStarter", provided that (i) you distribute the Software complete and unmodified and only bundled as part of, and for the sole purpose of running, your Programs, (ii) the Programs add significant and primary functionality to the Software, (iii) you do not distribute additional software intended to replace any component(s) of the Software, (iv) you do not remove or alter any proprietary legends or notices contained in the Software, (v) you only distribute the Software subject to a license agreement that: (a) is a complete, unmodified reproduction of this Agreement; or (b) protects BFA-IT's interests consistent with the terms contained in this Agreement, and (vi) you agree to defend and indemnify BFA-IT and its licensors from and against any damages, costs, liabilities, settlement amounts and/or expenses (including attorneys' fees) incurred in connection with any claim, lawsuit or action by any third party that arises or results from the use or distribution of any and all Programs and/or Software.
V. OWNERSHIP & INTELLECTUAL PROPERTY RIGTHS 
This Agreement gives you limited rights to use the Software. BFA-IT retains any and all rights, title and interest in and to the Software and all copies thereof, including copyrights, patents, trade secret rights, trademarks and other intellectual property rights. All rights not specifically granted in this Agreement, including International Copyrights, are reserved by BFA-IT. The structure, organization and code of the Software are valuable trade secrets and confidential information of BFA-IT.

VI. LIMITED WARRANTY AND DISCLAIMER 
YOU AGREE THAT THE BFA-IT SOFTWARE "JarProtector" CAN CONTAIN SOME BUGS, MALFUNCTIONS OR OTHER DEFECTS. BFI-IT SHALL NOT BE HELD LIABLE FOR ANY BUGS, MALFUNCTIONS OR OTHER DEFECTS CONTAINED IN, OR CAUSED BY YOUR USE OF, THE SOFTWARE. 
THE SOFTWARE IS PROVIDED ON AN "AS IS" BASIS AND BFA-IT MAKES NO WARRANTY OF ANY KIND, 
EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITATION, YOU ASSUME 
SOLE RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM THE SOFTWARE. BFA-IT MAKES NO 
WARRANTY THAT THE SOFTWARE WILL BE ERROR FREE OR FREE FROM INTERRUPTIONS OR OTHER 
FAILURES. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SOFTWARE, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO THIRTY (30) DAYS FROM THE DATE OF DELIVERY (AS EVIDENCE BY A COPY OF YOUR DOWNLOADING). NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY BFA-IT, ITS DEALERS, DISTRIBUTORS, 
AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY 
WARRANTY PROVIDED HEREIN.  

VII. TERMINATION 
You may terminate this agreement at any time by destroying the Software and all your copies of it, as well as all other related documents. BFA-IT may terminate this agreement if you fail to comply with these terms. Upon notice to You of such termination, You agree to destroy the Software and all your copies of it, as well as all other related documents.
 
VIII. LIMITATION ON LIABILITY 
IN NO EVENT SHALL BFA-IT NOR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES 
WHATSOEVER (INCLUDING BUT NOT LIMITED TO DAMAGES FOR: THE INABILITY TO USE EQUIPMENT OR ACCESS DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF CONFIDENTIAL OR OTHER INFORMATION) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF BFA-IT OR THIRD PARTY LICENSORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BFA-IT’S TOTAL LIABILITY TO YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER WILL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU FOR THE SOFTWARE THAT CAUSED SUCH DAMAGE.

IX. GENERAL 
This EULA will be governed by the laws of Switzerland. The limitations or exclusions of warranties, remedies or 
liability contained in this EULA shall apply to you only to the extent such limitations or exclusions are permitted under the laws of the jurisdiction where you are located. This EULA contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written. You agree that any varying or additional terms contained in any purchase order or other written 
notification or document issued by you in relation to the Software licensed hereunder shall be of no effect. No BFA-IT dealer, agent or employee is authorized to make any amendment to this EULA unless such amendment is in writing and signed by a duly authorized representative of BFA-IT. BFA-IT and other trademarks contained in the Software are trademarks or registered trademarks of  BFA-IT, in Switzerland and/or other countries. Third party trademarks, trade names, product names and logos may be the trademarks or registered trademarks of their respective owners.  You may 
not remove or alter any trademark, trade names, product names, logo, copyright or other proprietary 
notices, legends, symbols or labels in the Software. This EULA does not authorize you to use BFA-IT’s 
or its licensors' names or any of their respective trademarks.
